Application details:

Planning consent was obtained in 2008 for 'the erection of 160 holiday apartments, indoor swimming pool and cafe/bar and enhancement to part of the promenade.  The permission was subject to a S106 planning agreement dated 20 April 2011 which stipulates that prior to the occupation of more than 50% of the apartments:

1) The developer is to complete works to the nearby promenade (in accordance with the approved 'Promenade Scheme' - which should have been submitted within 3 months of the agreement) provided that the value / cost of such work shall not exceed £250,000, and,

2) The developer shall complete the swimming pool and make it available in accordance with an approved Public Access Scheme (which should also have been submitted within 3 months of the agreement.)

The agent has been in discussions with Torridge District Council and understands that the company (pre Administration) has, in principle, agreed a Deed of Variation relating to 1) above given the majority of the promenade works initially intended have now been carried out, funded via alternative means.

Torridge District Council and Devon County Council require an improved footpath link & the agent understands that a specification has been outlined and agreed and the variation (subject to Members' approval) will mean a purchaser is required to make a single contribution of £50,000 and a further single maintenance contribution of £15,000 plus reasonable legal costs.  Further, it is understood that regarding the Centre Core Block, in principle Torridge District Council is prepared to consider the impact its inclusion has on completing the development on the grounds of viability.

The freehold of the development consists of two separate title numbers (DN260840 & DN295694) both of which are owned by the Green Parks (Holdings) Ltd – In Administration (“GPH”) but are subject to two separate long-leases.
